O DIREITO À IGUALDADE E AS UNIÕES POLIAFETIVAS

Abstract

The purpose of this article is to demonstrate the impact and the need for Alexy 's right to equality, as an indirect means of state interference, for consolidating poliaffective unions. Thus, we must interpret legislation in the light of the Federal Constitution, recognizing the true essence of equality, and the legal system must guarantee respect and protection to the people, resulting in the effectiveness of the different forms of family in contemporary society, their structure and their application. In view of the different situations imposed, the right to equality presents itself as an element of citizen's access to the contemporary dictates that guide the effectiveness of poly-affective unions in the Democratic State of Law.
