LIMITS OF THE FREEDOM OF EXPRESSION AND THE USE OF NOTARIAL ACTS AS EVIDENCE

Abstract

The use of the notarial act, as a means of evidence to be presented in any judicial proceeding, when the limits of freedom of expression have been exceeded or when the guarantee of freedom of expression is obstructed, through the impartiality and independence of notaries, based on the publicity of their acts, the predictability of the procedure, legal certainty and the external control of their acts by the judiciary. It is a skillful and reliable instrument of prevention, protection and guarantee of evidence for a future litigation, so that the means are ensured so that the person can fully exercise the guarantee of his freedom of expression or compensate third parties, if there is an extrapolation of the limits of freedom of expression. Always observing the constitutional parameters and international conventions,  especially human rights, and the necessary control of conventionality.
